1. About these terms
These Terms of Use govern your access to and use of the EUCompany.org platform (“the Platform”), operated by Westcube Management BV (“we”, “us”). By using the Platform you accept these terms. If you do not accept them, please do not use the Platform.
2. What the Platform offers
- Quick Scan: a free, 15-question self-assessment that produces an indicative European digital-sovereignty classification.
- Extended Scan: a paid, in-depth assessment (35–50 questions across six domains) producing a self-verified classification.
- Public Directory: optional listing of classified companies.
- Badge: a dynamic, verifiable SVG badge that classified companies may embed on their own website.
- Knowledge Hub: editorial content on European alternatives and digital sovereignty.
3. Accounts
To run a scan, save results, or list your company in the directory, you need an account. You agree to provide accurate information, keep your credentials secure, and promptly notify us of any unauthorised use. You are responsible for all activity on your account.
4. Classification is not a certification
5. Classification cannot be bought
Paid features on the Platform are limited to the Extended Scan, enhanced directory visibility, and future premium tooling. Your classification outcome is determined solely by your answers and supporting evidence — never by payment. This is a founding principle of the initiative.
6. Payments
Paid features are invoiced through Mollie Payments. You agree to Mollie’s terms when completing a payment. Prices displayed are exclusive of VAT unless stated otherwise; applicable VAT is added at checkout. Payments are due immediately. For B2B customers within the EU, we may apply the reverse-charge mechanism where a valid VAT number is provided.
Because digital content is delivered immediately after payment, the 14-day right of withdrawal under EU consumer law does not apply once you start the Extended Scan. For business customers, the right of withdrawal does not apply.
7. Badge licensing
When your company achieves a classification, we grant you a limited, non-exclusive, non-transferable, revocable licence to display the EUCompany badge corresponding to that classification on your own website, marketing materials, and communications, only while the classification is active. You must:
- Use the dynamic badge embed code we provide (not static screenshots).
- Not alter the badge in any way.
- Stop using the badge within 30 days if your classification is withdrawn, downgraded, or your account is terminated.
We may revoke the badge licence if information you provided turns out to be inaccurate or misleading.
8. Acceptable use
You agree not to:
- Submit false or misleading information about your company.
- Attempt to circumvent the scoring logic, reverse-engineer the platform, or scrape the site at scale.
- Misuse the badge or claim a classification you have not been granted.
- Interfere with the Platform’s security or availability.
- Use the Platform in violation of any applicable law.
9. Intellectual property
Except for content you submit (“Your Content”), all intellectual property in the Platform — including the scoring methodology, the classification marks, the badge, logos, editorial content, and source code — belongs to Westcube Management BV or its licensors. You retain ownership of Your Content and grant us a worldwide, royalty-free licence to use, display, and process it to the extent needed to operate the Platform and deliver the services you have requested (such as public directory listing, if you opt in).
10. Availability and changes
We aim to keep the Platform continuously available but make no guarantee to that effect. We may update features, scoring criteria, pricing, or these Terms from time to time. Material changes are announced with reasonable notice. Continued use after changes take effect constitutes acceptance.
11. Termination
You may close your account at any time by contacting info@eucompany.org. We may suspend or terminate accounts that violate these terms, misrepresent information, or pose a security risk. On termination, your badge licence ends immediately and we apply the retention rules described in the Privacy Policy.
12. Limitation of liability
To the maximum extent permitted by applicable law, our total liability arising from or related to your use of the Platform is limited to the fees you paid to us in the twelve months preceding the event giving rise to the claim, and excludes indirect, consequential, or incidental damages. Nothing in these terms limits liability that cannot be excluded under mandatory law (such as liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence).
13. Indemnification
You agree to indemnify us against claims and damages arising from (a) your breach of these terms, (b) inaccuracy of information you submitted to the Platform, or (c) your misuse of the badge.
14. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent courts of Amsterdam, unless mandatory consumer protection law provides otherwise.
